By accessing or using SiteNav ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of Service

SiteNav provides an AI-powered chatbot platform for lead capture and customer engagement. Our Service includes:

  • Customizable AI chatbots for websites and web applications
  • Lead capture and management dashboard
  • Conversation analytics and reporting
  • Integration tools and embed codes
  • Data export functionality

3. Account Registration

To use certain features of the Service, you must register for an account. When registering, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any information that becomes inaccurate or incomplete
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights of others
  • Transmit spam, malware, or other harmful content
  • Collect personal information without proper consent
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any systems

5. Intellectual Property

5.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by SiteNav and are protected by international copyright, trademark, patent, and other intellectual property laws.

5.2 Your Content

You retain ownership of any content you submit, post, or display through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display such content solely for the purpose of providing the Service.

6. Payment Terms

For paid subscription plans:

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days notice
  • You authorize us to charge your payment method automatically
  • Failure to pay may result in suspension or termination of your account

7. Free Trial

We may offer a free trial period for new users. During the free trial, you will have access to certain features of the Service. At the end of the trial period, you will be required to subscribe to a paid plan to continue using the Service. We reserve the right to modify or discontinue free trials at any time.

8. Service Availability

We strive to provide 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (with advance notice when possible)
  • Emergency maintenance or repairs
  • Force majeure events
  • Third-party service disruptions

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITENAV SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, data, or business opportunities
  • Service interruptions or data loss
  • Unauthorized access to your data
  • Any third-party conduct or content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless SiteNav, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of a third party.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including:

  • Breach of these Terms
  • Violation of applicable laws
  • Fraudulent or illegal activity
  • Non-payment of fees

Upon termination, your right to use the Service will immediately cease. You may export your data within 30 days of termination notice.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of San Francisco County, California.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
